GENERAL

By commissioning me, you are stating that you have read and agree to these terms. If these terms are broken, you will be privately blacklisted from commissioning me, but your current commission will be completed.Prices shown are for personal use only.I retain all the rights to my work, which include but are not limited to the right to distribute, reproduce, copy and/or use the image as a sample for sales or self-promotion.I do NOT authorize usage of any of my pieces (or portions of my pieces) as NFTs. Furthermore, I do NOT authorize usage of any of my pieces (or portions of my pieces) to feed any AI generator or be used in an AI generator or its training in any way.Requested fanart of any kind is subject to being made into a printed good for my storefront for sale online. If you are not okay with this for any reason, you must specify that in the request and will be subjected to an additional privacy fee.I reserve the right to refuse any commission, art trade, and request, and do not need to provide a reason for doing so.Any ill behavior will not be tolerated. Similarly, please write in a clear manner in order to prevent miscommunication.I am only human (unfortunately) and will not necessarily match what you're looking for. I will go off of what you communicate to the best of my ability, but it may not be perfect. Please be understanding of that.Price will vary based on the complexity of the character design, background, or other elements as I deem fit. This will be clearly communicated to you when I give you the pricing information.

PAYMENTS

Payments can be completed as...
100% paid before I start on the commission.
50% paid before I start, 50% before or after I complete the line art of the commissioned illustration (or otherwise, via milestones, as discussed).
Otherwise-discussed payment plans, with proof of scheduled transactions.I will only start on the illustration after receiving either the full payment or partial payment (as agreed upon).Rush fees will put you on top of my to-do list! Rush fees are calculated taking the maximum amount of time for regular delivery (assuming I have no commission queue) and how quickly you need it.
E.G: You want one emote guaranteed in one week from the request date. Since that's half the time of estimated delivery, I would add an additional 50% rush fee.If you have a deadline, please be realistic with the date. I will not be able to provide you with a fully rendered illustration by the end of the week, much less by the end of the day. Again, I am only human.If you do not pay your invoice by the agreed upon date, your slot will be forfeited.

REVISIONS

Revisions will be offered at every step of the process (sketch, line art, coloring, rendering, etc.). After a stage is cleared, no additional revisions can be made to it.The only exception to this rule is if I were to forget a previously (and clearly) communicated design element. In that case, I will add it free of charge.

DEADLINES & DELIVERY

Time of delivery depends on...The quantity of commissions ahead of yours, and the timely response of those ahead (if any). You may view my work queue at any time on Trello or on my profile.Timeliness of your own response(s) in approving different stages of the commission.Complexity of the commission, my health, work, or unforeseen life circumstances.Payment, payment amount, etc. I will not finish your piece until I've been paid in full. If you've only paid 50% after 30 days and I've already started, I will not complete the illustration until the other 50% is received unless we've discussed otherwise.If you have a rush order but aren't actively communicating with me, you risk not having the commission completed as quickly as you'd like. If you have a deadline but fail to communicate with me and approve stages before that deadline, you risk not having the commission done on time.

USAGE

Personal use rights are free and the default for all commissions.

͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏for private, non-commercial purposes. This includes
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏enjoyment, education, or personal projects, as well as
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏anything not mentioned that does not generate profit or
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏promote a business.Commercial use rights for streaming purposes add a flat charge of 100% of the commission price.
͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏☆ Commercial use for streamers refers to the use of a
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏commission for any activity that generates income,
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏promotes a brand, company, or service, or uses the
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏commission for profit on platforms such as Twitch or
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏YouTube (this includes uploading as an emote or
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏utilizing as a profile picture on any platform you receive
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏profit from).͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏☆ This does NOT include the usage of the commission
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏to create merchandise.Commercial/Merchandising use rights are determine on a case-by-case basis, but you may reasonably expect a 10%-15% royalties agreement on top of an initial charge of 200% of the commission price.

͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏commission for any activity that promotes, displays, or
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏sells products through strategic placement, visual
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏design, and branding, both in physical stores and online.͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏☆ This includes usage in logos, usage on items such as
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏clothing or mugs, in-store displays, digital ecommerce,
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏and product licensing.If you're not sure what your commission usage plans fall into here, please reach out and we can discuss it!

I.P. RIGHTS

I.P., or Intellectual Property is a category of property that includes intangible creations of the human intellect. In this case, intellectual property refers to any digital work done by the Artist on behalf of a Commissioner or individual paying the Artist to complete a task.The commissioner/customer reserves the right to...Claim the rights to the character(s) in the illustration (if they are the "owner" or creator of said characters), but not the illustration(s) created during the course of a commissioned work. In the case of fan art, the commissioner/customer cannot claim either.Sharing/Reposting the illustration or otherwise commissioned work with the Artist's account on that platform "tagged", "mentioned", or otherwise credited in the post or image somewhere. (This typically looks like this : @crowbeecreates)Sharing/Reposting the illustration with a written or typed explanation that the Artist is @crowbeecreates. This can look like the following, but these are not the only accepted formats of this method of credit.

͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏knowledge and written permission.
͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏☆ Claiming the illustration or otherwise commissioned
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏work as your own.
͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏☆ Changing/Altering the illustration or otherwise
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏commissioned work in any way without the Artist's
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏explicit written consent__.
͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏☆ Directly tracing the illustration or otherwise
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏commissioned work and then sharing online without
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏proper credit. Tracing can be a good learning tool,
͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏ ͏͏͏͏͏͏but always share your references.

REFUNDS

If the commission is canceled by either the Artist or the Commissioner/Customer prior to work on the commission beginning, then the Commissioner/Customer will receive a full refund.Full refunds are not offered if I've already started working on your commission.When a commissioner/customer requests a refund, all work on that commissioner/customer's commission will stop until a written agreement is made.Refunds will not be given for completed or nearly completed commissions, regardless of the circumstances involved in the refund request.Partial refunds may be available on a case-by-case basis.
If the Artist states, in writing, that the Commissioner/Consumer is eligible for a refund, the following is what the Artist will reference for the amount owed.No refunds will be given for any commission with progress completed past the line art stage. If a refund request is communicated prior to line art approval, a refund of up to 50% will be considered. If a refund request is communicated after line art approval, there will be no refund of any amount considered.The Artist uses the following workflow : sketch → sketch approval → line art → line art approval → flat colors → base shading → flat colors & shading approval → rendering → rendering approval → final approval → final submissionsIf the Artist is, for any reason, unable to complete the commission, the Commissioner/Consumer will receive a full refund.
The Artist is not required to share the reason for being unable to complete it, but will do so if they see fit or deem it necessary.If the Artist has completed work on a commission prior to the cancelation of it, the Commissioner/Customer will receive multiple file types of the progress, and the Artist will not utilize anything other than the sketch for anything else.
